EPCM CONTRACTS MANAGEMENT

Key Function;
- Providing expertise and leadership, including procurement strategy development, contract development, negotiations and post award vendor management

Accountabilities;
- Determining best strategy for procurement of goods and services including developing strategies, procedures and linkages within while maximizing leverage opportunities
- Participate in and lead cross-functional teams to develop and implement supply chain strategies meeting client and corporate goals
- Provide commercial expertise to clients and ensure that corporate and local procurement policies ,procedures and guidelines are followed
- Maintain in-depth knowledge of local, Provincial and national social/economic objectives
- Procurement processes involve bid preparation and evaluation, recommendations, contract execution and administration
- Establishing effective channels of communication with clients and provide timely and effective feedback on status of contracts
- Manage vendor performance through formal vendor evaluations including follow-up for all non-conformance concerns as well as providing positive feedback to vendors
- Ensure all activities are done in strict compliance to corporate policy, practices and procedures are aligned with established code of ethics and business principles
- Apply procurement strategies, advice and guidance that will provide best value for the business, maximizing cost savings
- Required to interface with head office and other operating locations
- Responsible to manage contracts for goods and services
- Provide daily leadership to procurement team members including performance management, mentoring, training and succession planning while meeting assigned targets and objectives

- Prepared and issued commercial RFP’s / RFQ’s , tenders for goods and services
- Prepared and approved bidders list
- Formed contract agreements for onsite general contractor services, engineering services, consulting services, demolition and decommissioning work, maintenance services, non-disclosure(confidentiality), warranty work across multi-disciplines i.e., structural steel, mechanical, piping, civil/concrete, electrical/instrumentation
- Purchased engineered equipment
- Obtained material, fabrication or equipment pricing from domestic/international suppliers
- Prepared and issued Purchase Orders
- Purchased key bulk materials for large size capital projects
- Formed supply contract agreements
- Negotiated commercial terms in the best interest of owner/client
- Prepared spare parts proposals
- Expedited delivery of essential goods and materials and vendor drawings
- Managed vendor payment approvals, purchase order administration and delivery schedule adherence
- Coordinated vendor QA inspections with engineering personnel

- Broad mining industry knowledge including heavy industrial and oil sands projects
- Experience with software applications for ebidding i.e., Quest
- Experience using procurement processes i.e., SAP, JDE
- Proficiency in other Microsoft Office applications i.e., Excel, Word, Access
- Exposure and knowledge of project administration control systems in contracts

NEGOTIATION EXPERIENCE

Contract: Garson Mine Sand & Gravel Pit – Backfill Supply

Negotiated terms and rates with local material handling company to operate sand and gravel pit owned by Inco Limited. Revenue generated from the sale of each ton of material by negotiated price split with the material handling contractor and taking into account royalties owing to Provincial government.

Contract agreement negotiated was a 5 year term renewable contract that generated on average $2,000,000.00 revenue per year and approximately $10,000,000.00 in revenue at the end of 5 years.



Contract: Copper Cliff Smelter – Flash Furnace Rebuild

Negotiated contract terms and applicable rates for costs and firm completion date. Each day exceeding scheduled completion date results in over $2,000,000.00 in lost profit. Project work was completed on schedule.

Contract agreement was for an estimated value of $16,000,000.00. Final contract price calculated according to negotiated and agreed to contract terms and rates.


Contract: PCS Cory Red Product Expansion Project – HVAC System Design
& Installation

Entire budget calculated at $25,000,000.00 to fully execute this project.

The work was split equally between two industrial contractors that specialize in HVAC design and installation due to size and complexity of project.

Negotiated contract terms and rates for with each contractor using cost breakdown divided in four cost line items. Each cost breakdown in contract for each contractor was for an estimated value of $10,000,000.00.

Terms and rates negotiated for reimbursable costs in each contract agreement to control project cost in order to not exceed $25,000,000.00 approved budget.

Contract: Copper Cliff Smelter Flue Project

Negotiated contract terms and rates for construction project valued at $30,000,000.00.

Final contract price calculated with negotiated terms and rates to stay within predetermined budget.



Contract: McCreedy East Mine Development Phase 2A

Received several proposals from mining contractors to execute large scale underground development.

Compared proposals to determine which contract terms and rates will most benefit the owner.

Selected most favourable proposal and negotiated terms and rates to form a contract agreement valued at $45,000,000.00.



Contract: Crean Hill Mine Property - Demolition & Decommission

Received several proposals from contractors to demolish all surface mine structures and restore the land to acceptable environmental standards.

Negotiated terms and rates for the value of all scrap steel salvaged from owner’s property to determine credit to apply against final cost of project.

Total revenue generated with scrap steel totalled $1,500,000.00. This was applied as a deduction to calculate final contract price of $35,000,000.00


Contract: Coleman Mine – Ventilation Return Air Fan Design/Build

Received several proposals to design/build ventilation system to meet certain design criteria. Performance bond clause and Liquidated Damages
Clause included in contract agreement.

Value of the design/build contract was $5,000,000.00. Work was completed not to design criteria resulting in $1,000,000.00 operating loss per year.

Design/Build contractor would become insolvent if owner pursued remedy with consequential damages.

Negotiated a separate contract agreement after consulting legal counsel with the contractor. Formed a separate contract agreement that is
“in consideration of “ the Ventilation Return Air Fan Design/Build project to mitigate extra operating cost due to flawed design.

Contractor entered into this negotiated contract to perform regular maintenance on the fan installation at no cost to the owner. Cost for electrical power per year to operate this design flawed system would exceed
$800,000.00 per year. Negotiated 7 year warranty agreement managed to mitigate this loss by $300,000.00 per year avoiding approximately $2 million to $3 million in operating cost.
